1. Acceptance of terms
These Terms and Conditions ("Terms") govern your access to and use of AskBurg.com and the AskBurg assistant (together, the "Service"), provided by AskBurg ("AskBurg", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. The Service
AskBurg provides an AI-powered assistant that generates text responses based on the input you provide. We may add, change, or remove features at any time, and we may set or adjust usage limits to keep the Service reliable and fair for everyone.
3. Eligibility and accounts
You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Service. If we introduce accounts, you are responsible for the information you provide and for keeping your account credentials secure, and for all activity that occurs under your account.
4. Acceptable use
You agree not to use the Service to:
- Break the law or infringe the rights of others.
- Generate or distribute harmful, hateful, deceptive, or abusive content.
- Attempt to disrupt, overload, reverse engineer, or gain unauthorised access to the Service.
- Circumvent usage limits, security, or rate limiting.
- Use the Service to build a competing product by improperly extracting its outputs at scale.
- Submit content that contains malware or that you do not have the right to share.
5. Your content
You retain ownership of the content you submit to the Service. You grant us a limited licence to process that content as needed to operate and improve the Service and to provide responses to you. You are responsible for the content you submit and for how you use the responses you receive.
6. AI output and accuracy
The Service uses AI to generate responses, which may be inaccurate, incomplete, or out of date. Output is provided for general informational purposes only and is not professional advice of any kind, including legal, medical, or financial advice. You are responsible for evaluating and verifying any output before relying on it.
7. Intellectual property
The Service, including the AskBurg name, logo, software, and design, is owned by AskBurg and protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in and to the Service. You may not copy, modify, or create derivative works of the Service without our permission.
8. Plans and payments
The Service is currently offered free of charge within fair usage limits. Paid plans are planned for the future; when they launch, additional terms regarding fees, billing, renewals, and cancellations may apply and will be presented to you before you subscribe. Any free features may change or be discontinued.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, AskBurg and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months before the claim.
11. Termination
We may suspend or terminate your access to the Service at any time if you breach these Terms or if we need to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply.
12. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws applicable to AskBurg's place of business, without regard to conflict-of-law principles. Any disputes will be subject to the jurisdiction of the competent courts in that location, unless otherwise required by applicable law.
